Can I Sue a Nurse for Medical Malpractice?

Just like doctors, nurses can be found guilty of malpractice if failure to properly perform their duties ended in harm to a patient. However, not every blunder or unlucky mistake by a nurse warrants a medical malpractice suit.

You May Have a Nursing Malpractice Case if...

  • You were improperly medicated. This can happen when a nurse administers medication the wrong way or gives you the wrong medication altogether. It can also occur when a nurse does not exercise appropriate caution or fails to follow instructions regarding administration of medicine.
  • You were injured by medical equipment. You don't necessarily have a nursing malpractice case just because your nurse accidentally gave you a splinter with a tongue depressor or had to stick you in a few different places before finding a vein. However, you may be able to successfully claim malpractice if your nurse injured you by knocking over heavy equipment, burning you, leaving medical supplies inside your body during surgery, or otherwise wounding you.
  • Your nurse did not act in your best interest. If your nurse knew your medical issue was urgent and did not act accordingly, they may be guilty of negligence. The same applies when your nurse misses something important, such as rapid weight gain, shortness of breath, etc.

Liability in Cases of Nursing Malpractice

In many cases, the hospital where your nursing malpractice incident took place will bear legal and financial liability. This occurs when the nurse in question was employed by the hospital at the time of your injury and was performing a job-related task when the injury occurred. The supervising doctor may also be held liable, if they were present at the time of the incident and were able to monitor and influence the nurse's behavior.
